    Welcome to YardPass LLC ("YardPass," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of the YardPass website, mobile application, and services (collectively, the "Platform"). By using YardPass, you agree to these Terms.

    1. Overview of YardPass

    YardPass is a marketplace platform that connects property owners ("Hosts") with individuals seeking parking ("Fans" or "Guests") for events and other purposes.

    YardPass does not own, operate, or manage any parking locations. YardPass acts solely as a marketplace facilitating bookings between Hosts and Fans.

    2. Eligibility

    To use YardPass, you must:

    • Be at least 18 years old
    • Provide accurate and complete information
    • Comply with all applicable laws and regulations

    We reserve the right to suspend or terminate accounts at our discretion.

    3. Host Terms

    3.1 Host Responsibilities

    Hosts agree that:

    • They own or have legal control of the property listed
    • They have the right to offer parking at the listed location
    • The property is safe and suitable for parking
    • They will accurately describe parking conditions

    Hosts are responsible for: vehicle access, parking layout, guest instructions, and compliance with local laws and ordinances. YardPass is not responsible for Host property conditions.

    3.2 Host Verification

    YardPass may request government ID, address verification, property ownership confirmation, or a utility bill showing the host's name and address. Verification does not guarantee safety or suitability.

    3.3 Host Pricing

    Hosts set their own pricing for parking spots, premium spots, amenities, and season passes. YardPass may charge service fees to Hosts and/or Fans.

    3.4 Host Insurance

    Hosts are responsible for maintaining any insurance required for their property. YardPass does not provide insurance unless explicitly stated.

    3.5 Host Liability

    Hosts agree that they are responsible for their property, they assume all risks associated with offering parking, and YardPass is not liable for damages or injuries on Host property.

    4. Fan (Guest) Terms

    4.1 Booking Parking

    Fans agree to follow host instructions, park only in designated areas, respect host property, and follow arrival windows. Failure to follow rules may result in removal without refund.

    4.2 Vehicle Responsibility

    Fans park at their own risk. YardPass is not responsible for vehicle damage, theft, vandalism, or towing.

    4.3 Arrival and Departure

    Fans must arrive within the selected timeframe, follow host instructions, and avoid blocking vehicles unless permitted.

    5. Payments

    5.1 Fees

    YardPass may charge service fees, processing fees, and booking fees. Fees are displayed prior to booking.

    5.2 Host Payouts

    Host payouts are processed after event completion, may be subject to fees, and may be delayed for disputes or fraud review.

    6. Cancellations & Refunds

    Cancellations must be made at least 3 days before the event to be eligible for a full refund. Cancellations made within 3 days of the event are non-refundable. YardPass may issue refunds at its discretion for host cancellations, spot unavailability, or verified safety concerns. YardPass reserves final decision authority on all refund requests.

    7. Disputes

    YardPass may assist in disputes but is not obligated to resolve them. Users agree to cooperate with investigations.

    8. Prohibited Conduct

    Users may not:

    • Provide false information
    • Engage in illegal activity
    • Harass other users
    • Attempt to bypass YardPass payments
    • Misrepresent property

    Violation may result in removal.

    9. No Guarantee

    YardPass does not guarantee parking availability, property conditions, safety, or event access.

    10. Waiver of Liability

    By using YardPass, both Hosts and Fans acknowledge and agree:

    • Parking on private property involves inherent risks
    • Vehicles may be parked in yards, driveways, grass, or temporary parking areas
    • Hosts are independent property owners
    • YardPass does not control or inspect properties
    • Fans park at their own risk
    • Hosts assume responsibility for their property

    To the maximum extent permitted by law, users waive any claims against YardPass LLC for vehicle damage, theft, vandalism, property damage, personal injury, towing or ticketing, or event delays or cancellations.

    Users agree that YardPass LLC is a technology platform only and is not responsible for incidents occurring at parking locations.

    11. Indemnification

    Users agree to indemnify YardPass from claims arising from property use, parking incidents, host negligence, or guest negligence.

    12. Platform Availability

    We do not guarantee uninterrupted service. YardPass may modify or discontinue features at any time.

    13. Taxes

    Hosts are responsible for income taxes, local taxes, and reporting requirements. YardPass may issue tax forms where required.

    14. Termination

    YardPass may suspend or terminate accounts for violations, fraud, or safety concerns.

    15. Governing Law

    These Terms are governed by the laws of the State of Wisconsin.

    16. Changes to Terms

    YardPass may update Terms at any time. Continued use indicates acceptance.
